This study examined how research conducted at several federally funded institutions designated as Clinical Research Centers or Specialized Programs of Research Excellence addressed the issues of consent, control over biological materials, confidentiality, and disclosure of results in protocols and consent forms for genetic research with stored biological materials. Although a majority of the documents reviewed addressed most of the issues raised in the research ethics literature, topics identified in the literature that were missing include the return of research results, the (...) right to withdraw from research involving biological materials, and the consent of children when they become legal adults. If typical, these findings suggest greater educational efforts may be needed to prompt investigators and IRBs to consider these and other issues that were either not addressed in the protocols or consent forms or were addressed inadequately. We then argue that this oversight was not benign by considering two central issues in the field, informed consent and distributive justice, and showing how they might have been framed differently had infectiousness been at the forefront of concern. The solution to this omission might be to apply standard approaches in liberal bioethics, such as autonomy (...) and the harm principle, to infectious examples. We argue that this is insufficient, however. Taking infectious disease into account requires understanding the patient as victim and as vector. Infectiousness reminds us that as autonomous agents we are both embodied and vulnerable in our relationships with others. This paper examines the characteristics of infectious diseases that raise special medical and social ethical issues, and explores ways of integrating both current bioethical and classical public health ethics concerns. Many of the ethical issues raised by infectious diseases are related to these diseases’ powerful ability to engender fear in individuals and panic in populations. We address the association of some infectious diseases with high morbidity and mortality rates, the sense that infectious diseases are caused by invasion or attack on (...) humans by foreign micro‐organisms, the acute onset and rapid course of many infectious diseases, and, in particular, the communicability of infectious diseases. The individual fear and community panic associated with infectious diseases often leads to rapid, emotionally driven decision making about public health policies needed to protect the community that may be in conflict with current bioethical principles regarding the care of individual patients. The discussion includes recent examples where dialogue between public health practitioners and medical‐ethicists has helped resolve ethical issues that require us to consider the infected patient as both a victim with individual needs and rights and as a potential vector of disease that is of concern to the community. Syndromic surveillance uses new ways of gathering data to identify possible disease outbreaks. Because syndromic surveillance can be implemented to detect patterns before diseases are even identified, it poses novel problems for informed consent, patient privacy and confidentiality, and risks of stigmatization. This paper analyzes these ethical issues from the viewpoint of the patient as victim and vector. It concludes by pointing out that the new International Health Regulations fail to take full account of the ethical challenges raised by syndromic (...) surveillance. (shrink)

Since testing for HIV infection became possible in 1985, testing of pregnant women has been conducted primarily on a voluntary, ‘opt-in’ basis. Faden, Geller and Powers, Bayer, Wilfert, and McKenna, among others, have suggested that with the development of more reliable testing and more effective therapy to reduce maternal-fetal transmission, testing should become either routine with ‘opt-out’ provisions or mandatory. We ask, in the light of the new rapid tests for HIV, such as OraQuick, and the development of antiretroviral treatment (...) that can reduce maternal-fetal transmission rates to <2%, whether that time is now. Illustrating our argument with cases from the United States (US), Kenya, Peru, and an undocumented Mexican worker in the US, we show that when testing is accompanied by assured multi-drug therapy for the mother, the argument for opt-out or mandatory testing for HIV in pregnancy is strong, but that it is problematic where testing is accompanied by adverse events such as spousal abuse or by inadequate intrapartum or follow-up treatment. The difference is not a ‘double standard’, but reflects the presence of conflicts between the health interests of the mother and the fetus – conflicts that would be abrogated by the assurance of adequate, continuing multi-drug therapy. In light of these conflicts, where they still occur, careful processes of informed consent are appropriate, rather than opt-out or mandatory testing. (shrink)

The Writings of Charles De Koninck, Volume 1, introduces a projected three-volume series that presents the first English edition of the collected works of the Catholic Thomist philosopher Charles De Koninck. Ralph McInerny is the project editor and has prepared the excellent translations. The first volume contains writings ranging from De Koninck's 1934 dissertation at the University of Louvain on the philosophy of Sir Arthur Eddington, to two remarkable early essays on indeterminism and the unpublished book "The Cosmos." This paper seeks an urban poetics under the pressures of flux, polyglot babble and the rise of technoculture. In so doing it traces the intertwinements of aesthetics and politics as they manifest over the last 150 years. Charles Baudelaire’s poetry is characterised as a delirious response to the delirium of capitalist modernity, in which ‘words rise up’, as he puts it, but it is a also a barometer, which measures the degrees of entwinement of aesthetics and revolutionary politics in (...) the subsequent years, for one in Walter Benjamin’s interpretation in the 1930s and in the wild translations of the poet by Sean Bonney in 2008 in the collection ‘Baudelaire in English’. This comprehensive volume offers a wide-ranging perspective on the stories that art music has told since the start of the 20th century. Contributors challenge the broadly held opinion that the loss of tonality in some music after 1900 also meant the loss of narrative in that music. To the contrary, the editors and essayists in this book demonstrate how experiments in approaching narrative in other media, such as fiction and cinema, suggested fresh possibilities for musical narrative, which composers were quick (...) to exploit. The new conceptions of time, narrative voice, plot, and character that accompanied these experiments also had a significant impact on contemporary music. The repertoire explored in the collection ranges across a wide variety of genres and includes composers from Charles Ives and the Pet Shop Boys to Thomas Adès and Dmitri Shostakovich. (shrink)

The aim of this paper is to reconstruct Charles L. Stevenson’s metaethical view. Since his metaethical view is a form of emotivism, I will start by explaining what the core claims of emotivism are. I will then explore and comment on the specific claims of Stevenson’s proposal. Last, I will offer an overview of the objections that have traditionally been raised against emotivism.

Fagles), followed (on the more intimate thrust stage) by Charles L. Mee's adaptation of Aeschylus' Danaid trilogy, (...) entitled Big Love. Seeing these productions in tandem reminds one of the similarities between the two trilogies, as if Aeschylus in his Oresteia developed and expanded ideas introduced five years earlier in Danaides. These include the horrific consequences of male violence, not the least of which involves the tragic female response of killing husbands and turning households into bloodbaths. The primal compulsions that affect human beings--particularly eros and vengeance, immortally hypostasized as Aphrodite and the Furies--drive through both trilogies, countered somewhat by the religious and moral imperatives to grant beleaguered foreigners asylum. Reflecting Athens's radical democracy, Aeschylus emphasizes the perils and responsibilities of a polity that must face the consequences of its own decisions. In dramatic terms, both trilogies tap the power of choral lyric to wash over plot and action, almost like a force of nature, moving the human drama into a wider spatial and temporal context. Aeschylus also exploits the apparent finality of a trial in both works to bring matters to a dramatic close. However, ultimate resolution depends on the fundamentally comedic faith in the curative powers of marriage, family, and time to restore the human community. Addressing these themes in Big Love, Mee uses them to construct an entertaining romp. One could say he converts Aeschylus' Danaides into a contemporary satyr play, the paratragic genre for which Aeschylus was famous in antiquity (none of his survive, but one called Amymone ended the Danaid tetralogy).Although only Supplices is extant, most scholars agree on the [End Page 111] trilogy's dramatic arc. 1 Led by their father Danaos, the fifty Danaids flee from detested marriage with their Egyptian cousins. They receive asylum in Argos, until the Argive leader Pelasgos is defeated in battle and the victorious Egyptians have their connubial way. Commanded by their father, the Danaids murder their husbands on their wedding night--all save Hypermestra, who spares Lynkeus. A trial absolves Hypermestra of disobedience, and Aphrodite celebrates the power of eros, manifest in the marriage of earth and sky. Due to its incomplete story line and the absence of all but a few short fragments from the latter two plays, Supplices has not proved popular on the modern stage.Enter Charles Mee, whose updated version Big Love follows (mutatis mutandis) the reconstruction outlined above. Missing is Danaos, and (as one might expect) Aeschylus' lyrically and poetically charged language. It offers an evening of kitsch, froth, stage blood (over-the-top and inoffensive), and body-slamming physical humor. Although set in Italy--the Pelasgian Piero is a suave villa-owner who "makes arrangements" and "has connections"--this is very much an American play, full of commercial pop culture. CHARLES LESLIE STEVENSON, Associate Professor of Philosophy in the University of Michigan, though an American, has an important place in the evolution of British ethics in this century. It was in Mind that his first papers on ethics were published in 1937-8. They had considerable influence in Britain in promoting the emotive-persuasive theory of moral language. The author of the theory that much of philosophy and ethics is persuasive rhetoric, was himself a plausible illustration of his own theory. (...) His breeziness of style seemed to sweep difficulties out of the way. His papers had an unconventionality which appealed all the more to the younger generation of philosophers because it shocked the older. He seemed to discredit critics by not appearing able to understand the archaic language they were talking. The ideas of these early papers were taken up into a book, Ethics and Language published in 1944. The book is more ponderous and indeed somewhat pedantic. In it, Stevenson’s ideas lose in freshness what they gain in professorial gravity. But the impressive size of the book, the number and variety of the examples of moral argument which it discussed, the apparently wide range of the treatment, made the book for some time a sort of bible of emotivism. The book was also important as the first major study of ethics based on the neo-Wittgensteinian slogan that moral philosophy is the analysis of moral language. (shrink)

JACOBITISM AND DAVID HUME: THE IDEOLOGICAL BACKLASH FOILED It has often been said, and with some truth, that one of the weaknesses of the Jacobite movement was its lack of a systematic ideology or of a truly firstrate mind to expound its doctrines. There are of course those who would claim that in an earlier period Charles Leslie or Francis Atterbury easily fulfilled the necessary conditions (...) as expositors, and that this tradition was continued in the years immediately before the '45 by Carte and Chevalier Ramsay. Yet there were weaknesses in Jacobite doctrine, some of which will be noted below. It is less often realised that, qua logical cogency, the arguments of the Whigs and other opponents of Jacobitism were, to say the least, in no better case. In a word, anti-Jacobite ideology completely failed in the task of devastating the Stuarts and their followers. This failure is apparent when we consider the writings of David Hume, who addressed himself on many occasions, either explicitly or implicitly, to the question of Jacobitism. One of Hume's aims was to give the Revolution settlement and the Hanoverian succession the respectable intellectual basis it did not possess from official Whig ideology. In this aim Hume unquestionably failed, his arguments being either internally inconsistent or lacking in the intellectual rigour necessary to topple his targets. Following the method attributed to Karl Popper by Brian Magee, it will be instructive at this point to consider the anti-Jacobite case, not at its weakest, but at its strongest. In a word, it is proposed to consider in detail the political writings on the issue of Jacobitism of a man widely acknowledged to be the greatest British thinker of the eighteenth century and one of the finest philosophers of the ages. If the 172. most powerful mind in British philosophy was unable to contrive a theory or theories that could unseat Jacobitism as an ideology, this tends to indicate that the intellectual supports of the' doctrine were nothing like so feeble as Whig apologists claimed, and that historians have been rather too quick to claim that eighteenth-century Jacobitism depended on a defunct or discredited belief-system. First, however, two comments are necessary. Neither Jacobitism itself nor Hume's own writings possess the coherence the scholar might ideally wish for. Hume's critique has to be extracted from books and essays written over a thirty-year period, and none of these is a work of political theory per se. Moreover, these works address differing audiences and assume quite different things about the knowledge and philosophical acumen of their readers. This is quite apart from the fact that on some important issues Hume changed his mind over the years. At this level assessing Hume's meaning is often as difficult as the notorious problem of pinning down the 'real' Marx. As for Jacobitism, its ideology is difficult to articulate, since it was composed of many heterogeneous strands. The ideology of English Jacobites was a 'partial' view of the world. It embraced the pre-1688 Tory notions of hereditary and indefeasible right, passive obedience and non-resistance. It took in the 'Country' critique of corruption and its nostalgia for a lost 'golden age'. The ideology of Scottish Jacobitism came nearer to being a Weltanschauung. Apart from its role as an ideology of nationalism, stressing the importance of a unique Scottish culture, it depended on a providential and mystical view of the world. Basically, there were three types of ideological Jacobitism. The first type, whose major 173. tenets had been exhaustively debated during the period 1688-1720, concerned the notions of divine, indefeasible right, passive obedience and nonresistance. This doctrine, particularly associated with pro-Stuart polemicists like Charles Leslie and Francis Atterbury, was still very much alive in Jacobite circles by 1745, though the debate between Whig and Tory on its implications had to some extent given way to the debate between exponents of Court and Country positions. The second type was Jacobitism as an ideology of Scottish nationalism. This was particularly associated with the mystics of NorthEastern Scotland like Chevalier Ramsay, and was a powerful influence in the '45 rebellion. The third type was Jacobitism as... (shrink)

The article considers the fundamental motivations and associated theological thought of those involved in the Non-Juring schism in the Church of England in the period after the Revolution of 1688. It indicates and exemplifies how that thought is to be related to wider intellectual conflicts of the period, considered as constituting an early phase of Enlightenment/Counter-Enlightenment debate. The works of the leading Non-Juror theologian, Henry Dodwell, and in particular his writings on the destiny of the soul, serve as an area (...) of focus. Charles Taylor has been one of the most original and influential figures in contemporary philosophy: his 'philosophical anthropology' spans an unusually wide range of theoretical interests and draws creatively on both Anglo-American and Continental traditions in philosophy. A selection of his published papers is presented here in two volumes, structured to indicate the direction and essential unity of the work. He starts from a polemical concern with behaviourism and other reductionist theories which aim to model the study of man (...) on the natural sciences. This leads to a general critique of naturalism, its historical development and its importance for modern culture and consciousness; and that in turn points, forward to a positive account of human agency and the self, the constitutive role of language and value, and the scope of practical reason. The volumes jointly present some two decades of work on these fundamental themes, and convey strongly the tenacity, verve and versatility of the author in grappling with them.
